Terms of Use for Tider

These Terms of Use ("Terms") are a legal agreement between you and Delos Creator Hub ("Tider," "we," "us," or "our") governing your use of the Tider mobile application (the "App"). By downloading, installing, or using Tider, you agree to these Terms. If you don't agree, don't use the App.

1. Eligibility

You must be at least 13 years old to use Tider. If you are under the age of majority in your jurisdiction, you may only use Tider with the involvement of a parent or legal guardian.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Tider on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions (including the Usage Rules set forth in the App Store Terms of Service).

You may not:

• Copy, modify, or create derivative works of the App;
• Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law;
• Rent, lease, lend, sell, redistribute, or sublicense the App;
• Use the App for any unlawful purpose or in violation of any applicable law.

3. Your content

Tider is designed to run entirely on your device — it reads and, at your direction, deletes photos and videos from your own Photos library. You retain all rights to your photos and videos. We do not claim any ownership over your content, and as described in our Privacy Policy, your photo and video content never leaves your device.

Deletions are permanent once confirmed. Tider routes every deletion through Apple's own system confirmation dialog, and deleted items follow standard iOS behavior (e.g., they may remain in your device's "Recently Deleted" album for a limited time before permanent removal, per Apple's own retention policy — not Tider's). You are solely responsible for reviewing what you delete. We are not responsible for any loss of photos, videos, or other data resulting from your use of the App.

4. Account and Sign in with Apple

Creating an account is optional. If you choose to sign in with Apple, you're responsible for maintaining the confidentiality of your Apple ID credentials and for all activity that occurs through your account. You may delete your account at any time from within the App's settings, as described in our Privacy Policy.

5. Subscriptions

Tider offers an optional auto-renewing subscription ("Tider Pro") that removes ads and unlocks additional features (e.g. unlimited Magic Scans). The following terms apply to all subscriptions purchased through the App:

• Subscription length, pricing, and available plans (e.g. monthly, semi-annual, annual) are displayed in the App and on the App Store prior to purchase, and payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew for the same duration and price you originally purchased, unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price for the plan you selected.
• You can manage your subscription and turn off auto-renewal at any time by going to your Apple ID Account Settings on your device, after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.
• All payments are processed by Apple. Refunds are subject to Apple's own policies — we cannot issue refunds directly. To request a refund, visit reportaproblem.apple.com.

6. Advertising

Free-tier use of Tider is supported by ads served through Google AdMob, as described in our Privacy Policy. Subscribing to Tider Pro removes ads.

7. Acceptable use

You agree not to:

• Attempt to gain unauthorized access to any part of the App or its related systems;
• Interfere with or disrupt the App's operation, including any anti-abuse or credit-earning mechanisms;
• Use automated means (bots, scripts) to interact with the App or claim rewards/credits;
• Misrepresent your identity or impersonate any person or entity while using the App.

We reserve the right to suspend or terminate access to account-based features (such as Magic Scan credits or Tider Score) for violations of these Terms.

8. Intellectual property

The App, including its design, graphics, logos, and underlying code, is owned by Delos Creator Hub and protected by applicable intellectual property laws. Except for the limited license granted in Section 2, no rights are transferred to you.

9. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY MAGIC SCAN RESULTS (E.G. SIMILAR-PHOTO GROUPING) WILL BE ACCURATE OR COMPLETE. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING ANY CONTENT BEFORE DELETING IT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELOS CREATOR HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PHOTOS, VIDEOS, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $10.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Termination

We may suspend or terminate your access to account-based features at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the App and delete your account at any time.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify you in the App. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the United States, without regard to its conflict of law principles, except to the extent superseded by applicable local consumer protection law.

14. Apple App Store terms

Because Tider is distributed through Apple's App Store, the following additional terms apply and take precedence in the event of a conflict with Apple's own Licensed Application End User License Agreement:

• This agreement is between you and Delos Creator Hub only, not Apple, and Apple is not responsible for the App or its content.
• Apple has no obligation to furnish any maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes that third party's intellectual property rights.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
